El derecho político, tal como se entiende hoy, se fundamenta en 'El contrato social' de Rousseau: «Quiero averiguar si en el orden civil puede haber alguna regla de administración legítima y segura, tomando a los hombres tal como son y a las leyes tal como deben ser». La teoría del contrato, de la escuela naturalista de Grocio, precisa que los hombres se someten a una autoridad política por dos razones: bien por voluntad propia, bien por necesidad. A partir de Rousseau cada individuo recibe de modo libre y consentido los derechos que socialmente los demás miembros de la comunidad enajenan a esta.
