Synopsis "Sozialwissenschaftliche Theoriebildung und das Problem der Mediation (in German)"

Die Arbeit untersucht die grundsätzliche Problematik der Mediation als rechtliche Einrichtung. Dabei wird dargestellt, inwieweit sich die Mediation mit wichtigen rechts- bzw. sozialwissenschaftlichen Konzeptionen in Einklang bringen lässt. Nach der Lehre Kants hat das Recht freiheitsbegründende Funktion; Garant des Rechts ist allein der Staat. Demnach stünde die Institution der Mediation als au ergerichtliches Konfliktlösungsverfahren jenseits des Rechtes. Dagegen entspricht die Mediation als effektivitätsfördernde Institution nach Luhmanns Systemtheorie den Anforderungen an die Komplexreduktionskapazität des Rechtssystems. Auch nach Habermas' Diskurstheorie ist Mediation eine Institution, die näher an die diskursorientierte Situation legitimer gesellschaftlicher Beziehungen heranreicht, als dies Recht im traditionellen Verfahren leisten kann.
